Your privacy is of the utmost importance to us. This Privacy Policy explains how The Undeniable Project, LLC. and our affiliates (together, "Undeniable", "we" or "us") collect, use, and disclose information about you when you access or use our websites, mobile applications, and other online products and services (collectively, the “Services”), and when you contact our customer service team, engage with us on social media, or otherwise interact with us. Please note that certain of our products and services may be subject to a separate privacy policy. You will know this if those services link to a different notice rather than this policy.
Additional information for California residents can be found at the end of this Privacy Policy.
We may change this Privacy Policy from time to time. If we make changes, we will revise the date at the top of the policy and, in some cases, we may provide you with additional notice.
WHO WE ARE
Undeniable operates the Undeniable mobile application and undeniableproject.com. We are the data controller for the personal information described here. For questions please contact: support@undeniableproject.com. .
The Undeniable Project is intended for athletes who are at least 13 years of age. Our Services are not intended for children under the age of 13, and children under 13 are not permitted to create an account or use our Services.
We do not knowingly collect personal information from children under the age of 13. If we become aware that we have collected personal information from a child under 13 without the authorization required by applicable law, we will take appropriate steps to delete that information and terminate the child's account, subject to any applicable legal obligations.
If you believe that a child under 13 has provided personal information to us, please contact us at support@undeniableproject.com.
COLLECTION OF INFORMATION
Undeniable is a mental-performance training app for athletes 13 years old and older. We collect the minimum amount of information needed to run your account and training program, such as who you are, what you write in the app, and what portions of the training program you complete. No coach, teammate or other user can see the journal information and Undeniable does not access journal information except in the narrow cases described below. We do not use journal information to train AI. When you delete your account (Settings —> Delete Account) we delete your data from our systems. Parents and guardians of athletes under 18 years old can contact us regarding the privacy of their athlete’s data at support@undeniableproject.com.
INFORMATION YOU PROVIDE TO US
We may collect information when you register for an account, participate in interactive features, fill out a form or a survey, participate in a contest or promotion, make a purchase, communicate with us via social media sites, request customer support, or otherwise interact with us. The information you provide may include:
Account and Profile information: Full name, email address, password (stored only in secured hash form), date of birth (used to confirm that you are old enough to use the app), sex, sport and competitive level. Sex, sport and competitive level are used only to show you the most relevant training content.
Content you create: Journal entries, reflections and answers, plans and affirmations. This content is private to your account - coaches, teammates and other users cannot see this content, and it is never used to train AI models. Our staff do not access the content except where necessary to resolve a support request you make or to comply with a legal obligation.
Team access codes: If your team, club, or school gives you an access code, we only record that your account “redeemed” it. We do not tell the organization what you did in the app.
Support messages: If you email us, we will keep the correspondence so that we can better help you and understand the history and context of the issue you are having with the app.
Payment details: Payment information.
INFORMATION WE COLLECT WHEN YOU USE THE SERVICES OR INTERACT WITH US
When you use the Services or interact with us, we collect the following information about you:
Usage information: the sessions you use, videos you view, content you listen to, screens or features you access, and other similar types of usage information.
Transactional information: information about a purchase, such as product description, price, subscription and time and date of the transaction.
Log information: the web browser you use, app version, access times and dates, pages viewed, and your IP address.
Device information: information about the mobile device you use to access the Services, including the hardware model, operating system and version, device identifiers set by your device operating system, and mobile network information.
Communications: we may record our communications including chat messages.
We do not use advertising or cross-app tracking identifiers, cookies for advertising or third-party analytics SDKs.
INFORMATION WE COLLECT FROM OTHER SOURCES
We may also obtain information about you from other sources, including:
Purchase information: Subscriptions are bought through Apple (App Store) or Google (Google Play). Those entities process your payment and send us confirmation of your subscription status. Undeniable never receives your credit card details.
Social media data: If you create or log into your Undeniable account through a social media service account, we will have access to information from that account, such as your name and other account information, in accordance with your data sharing settings on that social media service.
WHAT WE DO NOT COLLECT
We do not: (1) collect your precise location; (2) access your contacts; (3) access your photos; (4) access your microphone; (5) access your camera data; (6) obtain biometric information about you; or (7) obtain government identifiers. We also do not sell your personal information.
HOW LONG DO WE KEEP INFORMATION?
Account and profile information, your content information, your activity and your purchase status are all kept until you delete them or delete your account. Be aware, however, that Apple and Google keep their own payment records, which we cannot delete.
Technical logs are held by our service providers in line with their own retention schedules.
We keep support messages for as long as we need them to handle your request, and a reasonable period after.
Deleting your account permanently deletes your account, profile, activity and redemption records from our production systems.
ADVERTISING AND PRIVACY PROTECTIONS FOR MINORS
The Undeniable Project is committed to protecting the privacy of young athletes who use our Services.
We may display advertisements, sponsorships, promotional content, or other commercial messages within our Services. We recognize that users under the age of 18 may be entitled to additional privacy protections under applicable federal and state laws.
ADVERTISING TO OUR USERS
We do not use the personal information of our users to deliver targeted advertising based on their activities across unrelated websites, applications, or online services.
We do not sell the personal information of our users or share their personal information with third parties for cross-context behavioral advertising.
We may display contextual advertisements or sponsorship messages based on the content being viewed, the general subject matter of the Services, or other information that does not involve prohibited tracking, profiling, or use of personal information.
For example, a user viewing content relating to basketball training may see an advertisement for basketball equipment. Such advertising will not be selected based on the user's mental health information, psychological assessments, or personal performance evaluations.
PROTECTION OF MENTAL PERFORMANCE INFORMATION
We do not use or disclose an athlete's journal information or daily assessments for targeted advertising.
We do not permit advertisers to use this information to develop advertising profiles of our users or to target users based on their actual or inferred mental or emotional characteristics.
THIRD-PARTY ADVERTISING PARTNERS
We may work with third-party advertisers, sponsors, or advertising service providers to display contextual advertisements or sponsorship messages within our Services.
We require these partners to comply with applicable privacy laws and contractual restrictions governing their access to and use of personal information.
Our advertising partners are not authorized to collect or use the personal information of our users for behavioral advertising, cross-context tracking, or the creation of advertising profiles.
Advertising Transparency
Advertisements and sponsored content displayed within our Services will be identified in a manner intended to distinguish commercial messages from our educational, training, and mental performance content.
We will not condition a user’s access to our Services on consent to advertising-related data processing.
HOW WE USE YOUR INFORMATION
We use the information we collect as follows:
To create and run your account and deliver the training content to you;
To show and track streaks and completion dates;
To personalize which training content you see (based on sport, sex and competitive level);
To send you account emails if required, such as confirmations or password resets;
To respond to you or your parent/guardian when you contact us;
Provide and maintain the Services, including debugging to identify and repair errors (the legal basis for this processing is the performance of the user agreement between you and Undeniable);
Improve the Services, including by developing new products and services (the legal basis for this processing is our legitimate interest in improving and developing new services, by exploring ways to further enhance our services and business);
Process transactions and fulfill orders (the legal basis for this processing is the performance of the user agreement between you and Undeniable);
Send you transactional or relationship messages, such as receipts, account notifications, customer service responses, and other administrative messages (the legal basis for this processing is our legitimate interest in providing relevant information about our services, including your purchases from us);
Detect, investigate, and prevent fraudulent transactions and other illegal activities and protect the rights and property of Undeniable and others, including to enforce our agreements and policies (the legal basis for this processing is our legitimate interest in preventing fraud and protecting and securing our assets, customers, employees and the public);
Comply with the law, such as by processing transactional records for tax filings and other compliance activities (the legal basis for this processing is compliance with our legal obligations under applicable law related to, for instance, taxation, and consumer protection law);
Create anonymous or aggregated data that no longer can be reasonably used to identify you (the legal basis for this processing is our legitimate interest in creating non-personally identifiable data to help improve our services, provide reports to third parties, and otherwise enhance and promote our business); and
We do not use your information for targeted advertising or to build individual advertising profiles. We do not use your content to train AI models.
DISCLOSURES OF INFORMATION
We may disclose information about you as follows and as otherwise described in this Privacy Policy or at the time of collection:
With companies and contractors that perform services for us, including email service providers, payment processors, fraud prevention vendors, analytics providers, advertising partners, and other service providers;
To accountants, auditors, lawyers, and other outside professional advisors to Undeniable, subject to appropriate contractual obligations of confidentiality;
If we believe disclosure is in accordance with, or required by, applicable law or legal process, including court order, subpoena, or other lawful requests by public authorities to meet national security or law enforcement requirements;
If we believe your actions are inconsistent with our user agreements or policies, if we believe you have violated the law, where necessary for the purposes of prevention, investigation, detection or prosecution of criminal offenses or the execution of criminal penalties, or to protect the rights, property, and safety of Undeniable or others, or if it is necessary for the establishment, exercise or defense of legal claims; and
If your Undeniable subscription has been provided to you by someone else, like your club who invited you to use one of their dependent subscriptions, we may inform them that you have signed up for the subscription they offered you.
WE DON’T SELL OR SHARE YOUR DATA
We do not sell personal information, and we do not share it for cross-context behavioral advertising. This applies to all of our users. Because we don’t share or sell information, there is nothing to “opt out” of. We also do not process information for targeted advertising or consumer profiling.
Because we do not track you across other companies’ apps or websites, there is no cross-site tracking for browser “Do Not Track” or Global Privacy Control signal to switch off.
THE SERVICE PROVIDERS WE WORK WITH
We use a small number of service providers to run the app. Each act on our instructions and is bound by contract to use the data only to provide their service to us, and to protect the data accordingly. Here is a list of the providers:
Supabase: Database and authentication hosting (account data, content and activity).
Mux: Video streaming. Mux receives standard delivery data such as IP addresses, device information and information on videos requested. It does not receive account content.
Apple and Google: Subscription purchases and payment processing.
Resend: Sending account emails (email address and message content).
YOUR PRIVACY AND YOUR PARENTS
Undeniable is designed to help you develop your mental performance as an athlete. You can create your own account if you are 13 or older, except where applicable law requires parental or guardian consent.
Undeniable does not provide parents with routine access to your private journal or confidential assessment responses. However, there may be circumstances in which we are legally required or otherwise legally authorized to disclose certain information to a parent, legal guardian, or another person. We will handle those requests in accordance with applicable law and our Privacy Policy.
If you have questions about who can see your information, please contact us at support@undeniableproject.com.
YOUR PRIVACY AND YOUR COACH
Undeniable will not share your private journal entries and individual mental performance assessments with your coach.
If you have questions about who can see your information, please contact us at support@undeniableproject.com.
PARENTAL AND LEGAL GUARDIAN ACCESS TO MINOR USERS' INFORMATION
The Undeniable Project ("Undeniable," "we," "us," or "our") provides a sports mental performance application intended for athletes ages 13 and older.
Athletes between the ages of 13 and 17 may create and maintain their own accounts without obtaining parental or legal guardian consent, except where such consent is required by applicable law.
We recognize that young athletes may use our Services to record personal thoughts, evaluate their mental performance, and document information concerning their confidence, motivation, emotional well-being, and athletic development.
We are committed to protecting the privacy of this information while respecting the rights of parents and legal guardians under applicable law.
Categories of Information Available to Parents and Legal Guardians: Subject to applicable law and the verification procedures described below, Undeniable may provide a verified parent or legal guardian with access to certain general information concerning their minor child's participation in our Services.
Such information may include:
Account registration and subscription information;
General training participation and activity;
Completion of training modules and educational exercises;
General athletic development and training progress; and
Other nonsensitive information that Undeniable makes available through its on request.
Access to this information will be limited to the categories authorized for parental viewing and will not automatically include access to the minor athlete's private journals, individual mental performance assessments, or other confidential information.
Protection of Private Journals and Mental Performance Assessments: Undeniable recognizes that athletes may use our Services to record personal thoughts, feelings, experiences, and other information relating to their mental performance and emotional well-being.
We distinguish between general training information and confidential personal information.
The following categories of information will not be made automatically available to parents or legal guardians through our parental-access features:
Private journal entries and personal reflections
Individual mental performance assessments and assessment responses
Information concerning an athlete's emotional state, anxiety, stress, confidence, or other sensitive psychological characteristics
Private communications or personal disclosures designated as confidential within our Services; and Other information that Undeniable identifies as sensitive or confidential.
A parent or legal guardian's ability to view general training progress does not, by itself, authorize access to these confidential categories of information.
Undeniable will not provide routine parental-account access to private journals or individual mental performance assessments.
However, these confidentiality protections are subject to applicable law. In circumstances where disclosure is legally required or otherwise legally authorized, Undeniable will evaluate the request and determine the scope of information that may or must be disclosed.
Verification of Parental Identity and Legal Authority: Before granting parental access to a minor athlete's information, Undeniable will take reasonable steps to verify the requesting individual's identity and authority to act on behalf of the minor.
Verification may include authentication through a verified parent or guardian account, confirmation of the individual's relationship to the minor, or review of appropriate supporting documentation.
Depending on the circumstances, we may request:
Government-issued identification or another reliable form of identity verification;
Documentation establishing the individual's parental relationship to the minor;
A court order or other documentation establishing legal guardianship; or
Additional documentation reasonably necessary to confirm the individual's legal authority to receive the requested information.
We will not require every requesting parent or guardian to provide all of these documents. The verification measures used will be proportionate to the sensitivity of the requested information, the circumstances of the request, and applicable legal requirements.
Possession of a minor athlete's account credentials, knowledge of the athlete's personal information, or payment of the athlete's subscription fees will not, by itself, establish parental or legal guardianship authority.
Requests for Confidential Information: A parent or legal guardian seeking access to information that is not ordinarily available through Undeniable's parental-access features may submit a request to support@undeniableproject.com.
Before disclosing private journals, individual mental performance assessments, or other confidential information, Undeniable will evaluate:
The identity and legal authority of the requesting individual;
The age and state of residence of the athlete;
The nature and sensitivity of the requested information;
Any applicable confidentiality protections or restrictions on disclosure;
Any authorization provided by the athlete, where relevant; and
Any applicable legal obligation requiring or permitting disclosure.
Undeniable may request additional documentation or clarification where reasonably necessary to determine whether the requesting individual is legally entitled to receive the information.
Undeniable will not disclose confidential information solely because an individual claims to be the athlete's parent or legal guardian.
Where applicable law requires disclosure to a verified and legally authorized parent or guardian, Undeniable will comply with that requirement.
Where disclosure is not legally required, Undeniable may decline to provide access to information designated as confidential, consistent with applicable law and the athlete's privacy rights.
Parental Requests to Exercise Privacy Rights: Parents and legal guardians may have rights under applicable law to request access to, correction of, or deletion of certain personal information relating to their minor children.
Undeniable will process such requests in accordance with applicable federal and state privacy laws.
A request to exercise a statutory privacy right will be evaluated separately from a request for routine access through Undeniable's parental-access features.
Where applicable law requires Undeniable to provide a verified and legally authorized parent or guardian with access to personal information, we will not deny that access solely because the information is excluded from our routine parental-access features.
Undeniable may require reasonable verification of the requesting individual's identity and legal authority before processing a request, consistent with applicable law.
We will respond to privacy rights requests within the time periods required by applicable law.
Disputed Parental Authority and Custody Restrictions: If Undeniable becomes aware of a dispute concerning parental or legal guardianship authority or receives conflicting requests from individuals claiming authority over a minor athlete's information, we may request additional documentation to determine the appropriate scope of access.
Such documentation may include applicable custody orders, guardianship orders, or other relevant legal records.
Undeniable will not presume that a parent lacks legal authority solely because the parent is divorced, separated, or does not have primary physical custody of the minor.
We will evaluate the individual's authority based on applicable law and any relevant legal documentation.
Where reasonably necessary, Undeniable may defer disclosure while reviewing the individual's legal authority, subject to applicable legal requirements and response deadlines.
Notification to Minor Athletes: Where appropriate and permitted by law, Undeniable may notify a minor athlete when a parent or legal guardian requests access to information that is not ordinarily available through our parental-access features.
Such notification may provide the athlete with an opportunity to identify concerns regarding the requested disclosure or provide information relevant to the request.
Undeniable may withhold or delay notification when required by law or when notification could create a material risk to the athlete's safety or interfere with a lawful investigation.
Notification to an athlete does not eliminate any disclosure obligation imposed by applicable law.
Users Who Reach Age 18: When an athlete reaches the age of 18, parental or legal guardianship access previously granted solely on the basis of the athlete's minor status will terminate, unless continued access is authorized by the athlete or otherwise permitted or required by law.
An adult athlete may authorize a parent or another individual to access specified information through any authorization features made available by Undeniable.
Undeniable will not disclose an adult athlete's confidential personal information to a parent solely because that parent previously had access to the athlete's account while the athlete was a minor.
Protection of Verification Information: Information collected to verify parental identity, or legal authority will be used only for verification, processing privacy requests, maintaining appropriate security and compliance records, and satisfying applicable legal obligations.
Undeniable will not use parental identification documents, custody records, guardianship documents, or other verification materials for advertising or marketing purposes.
We will maintain reasonable security measures to protect verification information and retain such information only for as long as reasonably necessary for the purposes described above or as otherwise required by law.
Where feasible, Undeniable may retain a record of successful verification without retaining copies of the underlying identification or legal documents.
Contact Information: Parents, legal guardians, and athletes may submit questions or requests concerning parental access, verification, or privacy rights by contacting:
